These Terms (“Agreement”) govern your access to and use of the Website and Services. By using the Services, you agree to this Agreement. If you are entering this Agreement for a business or other legal entity, you represent that you have authority to bind that entity. If you do not agree, do not use the Services.

1) Accounts & Membership

You are responsible for maintaining the security of your account and all activity under it. Providing false contact information may result in termination. Notify us immediately of any unauthorized use. We may suspend, disable, or delete your account if you violate these Terms or harm our reputation or Services.

2) User Content & License

We do not own content you submit via the Services (“Content”). You remain responsible for the accuracy, legality, and rights to your Content. By submitting Content, you grant us a non-exclusive license to host, store, reproduce, display, and otherwise process your Content as reasonably necessary to operate and improve the Services and for marketing or similar purposes as described on the Website.

We may, but are not obligated to, review Content and may remove or refuse Content that violates policies or is harmful.

3) Billing, Payments & Refund Policy

You agree to pay all fees in accordance with the prices and billing terms presented at purchase. If auto-renewal applies, your subscription renews automatically per your selected term until canceled. We may request identity verification for high-risk transactions. We reserve the right to change products and pricing and to refuse or cancel orders at our discretion.

Refund Policy (No Refunds)

No Refunds. Due to the nature of our services—granting immediate access to exclusive membership benefits upon entry into the members’ area—membership fees are non-refundable. You may cancel at any time to stop future billing.

Cancellation

You can cancel your membership at any time (effective at the end of the then-current billing period). For help canceling, contact us via our contact page.

4) Complimentary/Bonus Vacation Terms

Eligible annual memberships may include a complimentary vacation certificate at select hotels/resorts across various destinations. The following apply:

  • Taxes & Fees: You are responsible for applicable taxes, resort fees, and other destination-specific charges.
  • Additional Costs: Airfare, transportation, meals, gratuities, and incidentals are not included.
  • Activation: You must activate the certificate within 7 days of receipt by paying applicable taxes/fees.
  • Booking Window: After activation, you have 18 months to book. Availability, blackout dates, and restrictions may apply per property.
  • Non-Transferable: Redeemable only by the named recipient; no transfers.
  • No Cash Value: Not redeemable for cash or other compensation.

By redeeming a certificate, you agree to these terms and any additional rules presented during activation and booking.

5) Acceptable Use

You may not use the Services to engage in illegal, harmful, abusive, or infringing activities, including without limitation:

  • Distributing malware or performing denial-of-service attacks;
  • Collecting others’ personal information without consent;
  • Pornography/sexual content involving minors; prostitution or escort services;
  • Gambling, threats, harassment, violence, terrorism, weapons sales;
  • Unlawful drugs or prescription distribution;
  • Payment aggregation/facilitation for third parties;
  • Pyramid schemes, fraudulent or misleading practices;
  • Intellectual-property infringement;
  • Spam or unsolicited bulk communications (including to purchased lists);
  • Unauthorized scanning, probing, scraping, or access to systems or data;
  • Activities that degrade or overload our infrastructure.

We may remove content, suspend, or terminate accounts for violations and may report unlawful activity to authorities.

6) DMCA & Copyright Infringement

We respect intellectual property rights and respond to notices under the Digital Millennium Copyright Act (17 U.S.C. §512). Before submitting a notice, consider fair use. Misrepresentations may expose you to liability under §512(f).

Submit a DMCA Notice

Send a written notice with the following:

  • Identification of the copyrighted work(s) claimed infringed;
  • Identification of the infringing material (URL(s) where it appears) and enough information to locate it;
  • Your contact info (name, address, phone, email);
  • A good-faith statement that the use is not authorized by the owner, agent, or law;
  • A statement that the information is accurate and, under penalty of perjury, that you are authorized to act;
  • Your physical or electronic signature (full name).

Use our contact page: familyforadventure.com/contact. We may share your notice with the user who posted the material. If material is removed, we will provide information on filing a counter-notice.

Counter-Notice

To contest removal, send a counter-notice with:

  • Identification of the material removed and its prior location;
  • Your contact info (name, address, phone, email);
  • A statement, under penalty of perjury, of good-faith belief the material was removed due to mistake or misidentification;
  • Your consent to jurisdiction of the federal district court for your address (or any district where we may be found if outside the U.S.) and your agreement to accept service from the original complainant; and
  • Your physical or electronic signature.

Upon valid counter-notice, we may restore the material per the DMCA unless the original complainant files an action seeking a court order.

Your use of third-party services is subject to their terms and privacy policies. We are not responsible for their content, data handling, or actions. Enabling third-party integrations authorizes us to share data as necessary to facilitate the integration. Links on the Website do not imply endorsement.

To the fullest extent permitted by law, Project Four 28 LLC and its affiliates, officers, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, punitive, or consequential damages (including lost profits, revenue, goodwill, or data), arising from or related to your use of the Services, under any legal theory, even if advised of the possibility. Aggregate liability shall not exceed the greater of one (1) U.S. dollar or the amounts paid by you to us for the Services in the one (1) month preceding the first event giving rise to liability. These limits apply even if a remedy fails its essential purpose.

15) Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Texas and the United States, without regard to conflicts-of-law rules. The exclusive jurisdiction and venue for actions related to the subject matter hereof are the state or federal courts located in Texas, USA, and you consent to personal jurisdiction in such courts. You waive any right to a jury trial in any proceeding arising out of or related to these Terms. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
